According to Article 1312 The Constitution of Ukraine provides professional legal assistance in Ukraine, and Only a lawyer represents another person in court., and also protection from criminal charges.

Exceptions to representation in court:

  1. Labor disputes.
  2. Disputes regarding the protection of social rights.
  3. Disputes regarding elections and referendums.
  4. Disputes in minor disputes.
  5. Disputes regarding the representation of minors or minors and persons who have been declared incompetent or whose legal capacity is limited by a court.

By its legal nature, representation in court is a legal relationship in which one person (representative) acting on behalf of another person on the basis of certain powers (principal) and performs procedural actions in court in its interests, acquiring (changing, terminating) for her rights and responsibilities.

Any procedural action in court by one person in the interests of another person, as a result of which he acquires certain rights and obligations (including signing and/or submitting a certain procedural document to the court) is a representation, and therefore, such legal relations are subject to the provisions of Article 131.2 Constitution of Ukraine regarding exclusive representation by a lawyer of the interests of another person.

Representation in accordance with paragraph 3 of part one of Article 1311 and articles 1312 The Constitution of Ukraine provides that exclusively prosecutors or lawyers shall:

  1. In the Supreme Court and courts of cassation since January 1, 2017.
  2. In courts of appeal – from January 1, 2018.
  3. In courts of first instance – from January 1, 2019.
  4. Representation of state authorities and local governments in courts exclusively by prosecutors or lawyers has been carried out since January 1, 2020.
