In Ukraine, there are 5️ stages of inheritance by law, which are called upon to inherit alternately in the order specified by law.
The testator's children, including those conceived during the testator's lifetime and born after his death, the second spouse, and parents, have the primary right to inherit under the law.
Secondly, the testator's siblings, his grandparents on both the father's and mother's side, have the right to inherit by law.
Thirdly, the testator's uncle and aunt have the right to inherit by law.
Fourth, the right to inherit by law is granted to persons who lived with the testator in the same family for at least five years prior to the opening of the inheritance.
Fifthly, the right to inherit by law is held by other relatives of the testator up to and including the sixth degree of kinship, with relatives of a closer degree of kinship excluding relatives of a further degree of kinship from the right to inherit. The degree of kinship is determined by the number of births separating the relative from the testator. The birth of the testator himself is not included in this number.
Also, in the fifth place, the right to inherit by law is granted to the testator's dependents who were not members of his family.
Inheritance by right of representation is regulated by Article 1266 of the Civil Code, which defines the circle of heirs at law who are called upon to inherit in the event of the death of their relative before the opening of the inheritance. Thus, one person, in the event of the death of another person who is an heir at law, before the opening of the inheritance acquires the right to inherit that share in the inherited property that the deceased heir would have received if he had been alive at the time of opening the inheritance.
Grandchildren, great-grandchildren, great-grandparents, nephews, cousins, and sisters may inherit by right of representation. This list of persons is exhaustive and cannot be expanded.
An heir by will or by law who died after the opening of the inheritance and did not have time to accept it, the right to accept the share of the inheritance due to him, in addition to the right to accept the mandatory share in the inheritance, passes to his heirs (hereditary transmission).
