According to Clause 3 of Article 23 of the Law of Ukraine «On Mobilization Preparation and Mobilization», men who are dependent on three or more children under the age of 18 have the right to a deferral, except for those who have arrears in alimony payments, the total amount of which exceeds the amount of payments for three months.
A father is not entitled to a deferral if he does not live with his children and does not pay child support.
The entry in the birth certificate itself does not give the conscript the right to a deferment - the father must support his children.
A man is not entitled to a deferral if he is raising a foster child, but the biological father pays child support. In this case, the child is dependent on the biological father.
To obtain a deferment, you must personally submit an application to the head of the CCC and SP commission at the place of military registration.
The application form is specified in Appendix 4 of the Resolution of the Cabinet of Ministers of Ukraine No. 560 dated May 16, 2024.
The application must be accompanied by supporting documents, the list of which is specified in Appendix 5 of the same Resolution.
